TOURFLOW Privacy Policy Last Updated: April 2026 | Effective upon use of the platform

TourFlow LLC ("TourFlow," "we," "us," or "our") operates tourflow.us and the TourFlow platform (the "Platform"). This Privacy Policy explains what data we collect, how we use it, who we share it with, and what rights you have. By using the Platform, you agree to the practices described here.

1. Who This Policy Covers

This Policy applies to everyone who interacts with the Platform, including:

  • Fan Uploaders who submit content via QR code or direct link;

  • Artist Users and Management / Label Users who access the dashboard; and

  • Visitors who browse the Platform without uploading content or creating an account.

2. Data We Collect

2a. Data You Provide Voluntarily

  • Contact information: phone number and/or email address, if entered during the fan upload flow or account registration;

  • Account credentials: name, email, and password for artist and management accounts; and

  • Content: any photos, videos, audio recordings, or other files you upload to the Platform, including any metadata embedded in those files such as GPS location, timestamps, and device information.

2b. Data We Collect Automatically

When you access the Platform, we automatically collect IP address; device type, operating system, and browser version; referring URLs and pages visited within the Platform; and event-level data such as which artist, tour, or show triggered your session.

2c. Data We Do Not Collect

We do not collect payment card information directly. We do not knowingly collect data from persons under 18. If you believe a minor has submitted data through the Platform, contact us immediately at legal@tourflow.net.

3. How We Use Your Data

We use the data we collect to:

  • operate and improve the Platform and its features;

  • organize and deliver uploaded content to the correct artist and management dashboard;

  • send marketing communications via email or SMS, where you have provided consent;

  • build and maintain fan contact lists on behalf of artists, as described in Section 4;

  • conduct analytics to understand how the Platform is used;

  • enforce these Terms and our legal rights;

  • comply with applicable law and respond to lawful requests from government authorities; and

  • support fundraising, investor due diligence, and internal business operations, using aggregated or anonymized data where possible.

4. How We Share Your Data

4a. With Artists and Their Teams

Content you upload and any contact information you voluntarily provide is shared with the artist associated with the event for which you uploaded. That artist and their management team may use your contact information for their own marketing communications, subject to applicable law. TourFlow is not responsible for how artists handle data once it has been shared with them.

4b. With Service Providers

We work with third-party vendors who help us operate the Platform, including cloud storage and hosting providers, analytics platforms, and communication infrastructure providers. These vendors access data only as necessary to provide their services and are contractually bound to protect it.

4c. With Successors

If TourFlow is acquired, merged, or undergoes a change of control, your data may be transferred to the successor entity. We will notify users via the Platform or email in advance of any such transfer where practicable.

4d. For Legal Compliance

We may disclose data when required by law, court order, or valid government request, or when we believe disclosure is necessary to protect the rights, safety, or property of TourFlow, our users, or the public.

4e. What We Do Not Do

We do not sell your personal data to third parties. We do not share your data with advertisers for ad targeting purposes.

5. SMS and Email Communications

If you provide a phone number through the Platform, you expressly consent to receive automated marketing text messages from TourFlow and from the associated artist. Standard message and data rates may apply. This consent is not a condition of uploading content or receiving any service.

To opt out of TourFlow SMS communications, reply STOP to any message. To opt out of email communications from TourFlow, use the unsubscribe link in any email. Opting out of TourFlow communications does not automatically opt you out of communications sent directly by the artist, and vice versa.

TourFlow complies with the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act. Artists who receive fan contact data through TourFlow are independently responsible for their own compliance with applicable communications law.

6. Data Retention

We retain personal data for as long as necessary to fulfill the purposes described in this Policy, maintain active artist accounts, comply with legal obligations, and resolve disputes.

Fan contact data (phone numbers and email addresses) is retained for as long as the associated artist account remains active on the Platform, unless you opt out earlier. Uploaded content is retained in perpetuity unless you submit a valid deletion request as described in Section 8, and subject to the license rights granted in our Terms of Service, which survive deletion requests.

7. Data Security

TourFlow implements commercially reasonable technical and organizational measures to protect your data against unauthorized access, disclosure, alteration, and destruction. These measures include encrypted data transmission, access controls on internal systems, and secure cloud infrastructure.

No system is completely secure. TourFlow is not liable for unauthorized access to your data resulting from circumstances beyond our reasonable control. If we become aware of a data breach that affects your personal information, we will notify affected users in accordance with applicable law.

8. Your Rights

Depending on where you are located, you may have the following rights regarding your personal data:

  • Access: request a copy of the personal data we hold about you;

  • Correction: request that we correct inaccurate or incomplete data;

  • Deletion: request that we delete your personal data, subject to our legal obligations and the license rights already granted under our Terms of Service;

  • Objection: object to our processing of your data for marketing purposes; and

  • Portability: request a machine-readable copy of your data where technically feasible.

To exercise any of these rights, contact us at legal@tourflow.net. We will respond within 30 days. We may need to verify your identity before processing your request.

Note on uploaded content: because uploaded content is licensed to TourFlow and to artists under our Terms of Service on an irrevocable basis at the time of upload, a deletion request removes the content from our active systems but does not revoke rights already granted to artists who have downloaded or used that content prior to deletion.

9. Cookies and Tracking

The Platform uses cookies and similar tracking technologies to maintain session state for logged-in users, analyze usage patterns and Platform performance, and remember preferences.

You can control cookie behavior through your browser settings. Disabling cookies may affect certain Platform functionality. We do not currently respond to browser-level Do Not Track signals.

10. Third-Party Links

The Platform may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

11. Children

The Platform is not directed at or intended for use by persons under 18. We do not knowingly collect personal data from minors. If we become aware that a minor has submitted personal data through the Platform, we will take steps to delete that data promptly. If you believe a minor has submitted data, contact us at legal@tourflow.net.

12. Changes to This Policy

We may update this Privacy Policy at any time. When we do, we will post the revised Policy on the Platform with an updated "Last Updated" date. Your continued use of the Platform after any update constitutes acceptance of the revised Policy. If the changes are material, we will make reasonable efforts to notify users via email or a notice on the Platform.
